Kasper Mechanical LLC ("Kasper Mechanical," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information in connection with our heating, ventilation, air-conditioning, plumbing, electrical, indoor-air-quality, and related services; our websites and online forms; telephone calls, text messages, and emails; advertising and social-media activity; employment and recruiting; and other interactions with us (collectively, the "Services").

This Privacy Policy applies to customers, prospective customers, website visitors, people who communicate with us, job applicants, and current and former personnel, as applicable. It does not apply to a third-party website, platform, or service that has its own privacy policy.

1. Personal Information We Collect

Depending on how you interact with us, we may collect the following categories of personal information:

  • Contact and identity information, such as your name, billing or service address, email address, telephone number, account or customer number, and preferred method of contact.
  • Service and property information, such as information about your home or business, HVAC or other mechanical equipment, service history, maintenance plans, warranties, estimates, invoices, appointment details, property access instructions or codes, photographs or videos of equipment or work areas, and communications concerning requested or completed work.
  • Transaction and payment information, such as purchases, deposits, balances, payment status, financing selections, and limited payment-card or bank-payment information. Payment information may be collected and processed directly by our payment processors or financing providers; we may not receive or retain complete card or bank-account numbers.
  • Communications, including emails, text messages, online chats, form submissions, reviews, survey responses, and recordings or transcripts of telephone calls.
  • Website, device, and advertising information, such as Internet Protocol address, browser and device type, operating system, referring pages, pages viewed, approximate location derived from an IP address, dates and times of visits, cookie or advertising identifiers, interactions with advertisements, and similar usage information.
  • Lead and referral information, including information received from lead aggregators, referral sources, advertising platforms, manufacturers, home-warranty companies, property managers, contractors, or another person who asks us to contact you.
  • Social-media information, such as your public profile information, comments, messages, reactions, and other information you make available when interacting with us through Google, Meta/Facebook, or other social-media platforms.
  • Business-contact information, such as an employer, job title, business address, and information related to commercial accounts, vendors, and professional relationships.
  • Applicant and workforce information, such as employment history, qualifications, licenses, certifications, references, background-screening information where permitted by law, payroll and benefits information, performance and training records, emergency contacts, and other information reasonably related to recruitment or employment.
  • Other information you choose to provide or that we are permitted or required by law to collect.

We do not intend to collect sensitive personal information unless it is reasonably necessary for a legitimate business purpose, an employment relationship, a transaction you request, or compliance with law. Please do not send Social Security numbers, complete financial-account credentials, medical information, or other sensitive information through an unsecured website form, electronic mail (e-mail), text message, or social-media message.

2. How We Collect Information

We may collect personal information:

  • directly from you, your household, or an authorized representative;
  • when you schedule service, request an estimate, purchase services, make a payment, enroll in a maintenance plan, submit a form, communicate with us, apply for employment, or otherwise interact with us;
  • automatically through cookies, pixels, analytics tools, call systems, and similar technologies;
  • from ServiceTitan and related features, including Scheduling Pro; Podium; payment and financing providers; Google; Meta/Facebook and other social-media platforms; lead aggregators; referral sources; advertising and analytics providers; public sources; and other service providers or business partners; and
  • from our employees and technicians in connection with service delivery, business administration, recruiting, or employment.

If you provide us with information about another person, you represent that you are authorized to do so and, when required by applicable law, have provided appropriate notice or obtained appropriate consent.

3. Telephone Call Recording

We record inbound and outbound telephone calls for customer service, scheduling, training, quality assurance, documentation, security, dispute resolution, and legal compliance. A recording notice may be provided at the beginning of a call. By remaining on a call after receiving notice, you consent to the recording to the extent consent is required by applicable law.

If you do not wish to be recorded, tell the representative promptly. We may offer another reasonable communication method when practicable, but some matters may require telephone verification or documentation.

4. How We Use Personal Information

We may use personal information to:

  • respond to inquiries and provide estimates;
  • schedule, dispatch, perform, document, and follow up on services;
  • communicate booking confirmations, appointment reminders, technician dispatch information, service updates, estimates, invoices, warranty information, maintenance reminders, and review requests;
  • establish and manage customer accounts, maintenance plans, warranties, and business relationships;
  • process payments, financing, refunds, collections, and accounting records;
  • provide customer support, investigate concerns, resolve disputes, and enforce agreements;
  • maintain service history and improve safety, quality, training, and operations;
  • personalize and improve our websites, communications, advertising, and Services;
  • measure advertising performance, understand audience trends, conduct analytics, and carry out remarketing or targeted advertising;
  • send promotions, special offers, and other marketing communications, where permitted by applicable law;
  • detect, investigate, and prevent fraud, misuse, security incidents, and unlawful activity;
  • recruit, employ, manage, compensate, train, and protect personnel;
  • comply with laws, regulations, licenses, tax obligations, subpoenas, court orders, and valid government requests; and
  • protect the rights, safety, property, and legal interests of Kasper Mechanical, our customers, personnel, and others.

If Kasper Mechanical undergoes a merger, acquisition, sale of assets, or other business transaction, personal information may be transferred as part of that transaction, subject to applicable law.

We may use information for another purpose disclosed when it is collected or with your consent.

5. Text Messages, Email, and Marketing Communications

We may send service-related communications, including booking confirmations, appointment reminders, dispatch notifications, estimate follow-ups, maintenance reminders, payment or account notices, and review requests. We may also send promotional text messages or emails when permitted by law and consistent with any consent you have provided.

Consent to receive promotional calls or text messages is not a condition of purchasing goods or services from us. Message frequency may vary, and message and data rates may apply. You may opt out of promotional text messages at any time by replying STOP or UNSUBSCRIBE. You may opt out of promotional emails by using the unsubscribe link in the email. You may also contact us using the information in Section 15.

After an opt-out request, we may send one non-promotional message confirming the request. We may continue to send communications that are necessary to provide requested services, protect an account, process a transaction, comply with law, or address an ongoing business relationship, to the extent permitted by law. Opting out of marketing does not cancel an appointment, maintenance plan, contract, or other service arrangement.

This Privacy Policy describes our practices but does not, by itself, constitute consent to receive marketing calls or texts where separate consent is required by law.

6. Cookies, Analytics, and Targeted Advertising

Our websites and advertising partners may use cookies, pixels, tags, software development kits, local storage, and similar technologies. These technologies may collect website, device, and advertising information to operate our websites, remember preferences, understand usage, prevent fraud, measure advertising, and provide or assess ads that may be more relevant to you.

We may use services provided by Google, Meta/Facebook, and other analytics, social-media, and advertising providers. These providers may receive online identifiers and information about your activity on our websites or advertisements. They may combine that information with information collected through other websites, applications, devices, or services, subject to their own privacy policies. Although this information may not directly include your name, online identifiers and activity data may be considered personal information under some laws.

You can manage cookies through your browser settings and, when available, our website cookie controls. Blocking cookies may affect website functionality. You may also use the privacy and advertising controls offered by Google, Meta, and other platforms. Where required by applicable law and supported by our systems, we will recognize legally valid browser-based opt-out preference signals.

We may use aggregated or de-identified information for analytics, operational planning, and marketing. We will not attempt to re-identify information that we maintain as de-identified, except as permitted by law to test whether our de-identification processes are effective.

7. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients for legitimate business purposes:

  • Technology and operations providers, including ServiceTitan and related scheduling tools, Podium, website hosting and form providers, telecommunications and call-recording providers, data-storage providers, cybersecurity providers, and other vendors that support our business.
  • Payment, financing, and collection providers that process transactions, offer customer financing, prevent fraud, or assist with lawful collection activity.
  • Service partners, such as subcontractors, manufacturers, distributors, warranty administrators, inspectors, utilities, permitting authorities, and other parties involved in providing or supporting requested services.
  • Advertising, analytics, and social-media providers, including Google, Meta/Facebook, and similar companies, for analytics, audience measurement, advertising, remarketing, and targeted advertising.
  • Lead aggregators and referral partners. We may receive your information from these parties. We disclose directly identifiable customer information back to or through a lead source only when you have consented, when needed to respond to your request, or when otherwise permitted by law.
  • Professional advisers, including accountants, auditors, attorneys, insurers, consultants, and other advisers subject to appropriate duties of confidentiality.
  • Government authorities and other parties when disclosure is required by law or reasonably necessary to protect rights, safety, property, or legal interests; investigate fraud or wrongdoing; respond to legal process; or enforce our agreements.
  • Parties to a business transaction, such as a purchaser, successor, lender, investor, or adviser involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of some or all of our business or assets, subject to appropriate safeguards where required.
  • Other recipients at your direction or with your consent.

We do not sell personal information for money. Our use of advertising cookies and similar technologies may, however, be treated as a "sale," "sharing," or processing for targeted advertising under certain privacy laws. You may request to opt out as described in Section 11.

We may disclose aggregated or de-identified information that cannot reasonably be used to identify you.

8. Payment and Financing Services

Payment processors, banks, and financing providers may collect information directly from you and apply their own privacy policies and terms. Kasper Mechanical does not control their independent privacy practices. Choosing to apply for financing may require the provider to collect identity, income, credit, or other financial information and conduct a credit inquiry. Please review the provider's notices before submitting information.

9. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide services; maintain equipment, warranty, tax, accounting, employment, and transaction records; satisfy contractual and legal obligations; resolve disputes; prevent fraud; and enforce agreements.

Retention periods vary based on the type and sensitivity of information, the nature of our relationship, applicable limitation periods, legal requirements, and operational needs. When information is no longer reasonably needed, we may delete it, de-identify it, or securely dispose of it, subject to technical limitations in backup and archival systems.

10. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, loss, or disclosure.

No method of transmission or storage is completely secure. Accordingly, while we take reasonable measures to protect personal information, we cannot guarantee that information will be completely secure or that unauthorized access, use, disclosure, or loss will never occur.

You are responsible for using appropriate care when sending sensitive information and for protecting any account credentials or access codes. If you believe information you provided to us has been compromised, contact us promptly using Section 15.

11. Your Privacy Choices and Requests

Subject to applicable law and appropriate identity verification, you may have rights that entitle you to ask us to:

  • confirm whether we process personal information about you;
  • provide access to or a copy of certain personal information;
  • correct inaccurate personal information;
  • delete certain personal information;
  • opt you out of promotional communications;
  • opt you out of certain targeted advertising or disclosures treated as sales under applicable law; or
  • review a decision we make concerning a privacy request, when an appeal right applies.

To submit a request, contact us using Section 15 and clearly state that you are making a privacy request. We may ask for information reasonably necessary to verify your identity and authority. An authorized agent may submit a request where permitted by law, but we may require proof of authorization and verification of the consumer's identity.

These rights are not absolute, and may be subject to limitations and exceptions under applicable law. We may deny or limit a request when permitted by law, including when information is needed to complete a transaction, provide requested services, protect security or legal rights, maintain required business records, comply with law, or exercise or defend legal claims. If a particular privacy law does not apply to Kasper Mechanical or to the information at issue, we may consider a request voluntarily but are not representing that a legal right applies.

12. Children’s Privacy

Our Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information online from children under 13. If you believe a child under 13 has provided personal information to us, contact us so we can review and, when appropriate, delete it.

We will respond to an authenticated request without undue delay and, in all cases, within 45 days of receipt of a request. If reasonably necessary, taking into account the complexity and number of requests, we may extend the response period once by an additional 45 days, and will provide an explanation for the reason for the extension. If a request is manifestly unfounded, excessive, or repetitive, we may charge a reasonable fee to cover the administrative costs of responding or may decline to act upon the request, as permitted by applicable law. If we decline to take action on your request, we will notify you without undue delay within 45 days. Our response will contain the reason for our decision and provide instructions for appealing the decision.

Appeal. If we decline to take action on a request, you may appeal our decision by contacting us using the appeal method identified in Section 15. Your appeal should identify the request, and if possible, include the reasoning for why you believe our decision should be reconsidered. We will respond to an appeal within 60 days of receipt of the appeal. If reasonably necessary, we may extend the appeal response period by an additional 60 days, and we will provide an explanation for the extension. If we deny your appeal, we will provide you with information about how you may contact the Virginia Attorney General to submit a complaint.

13. Job Applicants and Personnel

For applicants and personnel, we use personal information for recruiting, evaluating qualifications, background screening where authorized, onboarding, payroll, benefits, scheduling, training, performance management, safety, security, legal compliance, and other legitimate employment purposes. We may disclose such information to payroll and benefits providers, screening providers, insurers, professional advisers, government authorities, and other vendors supporting workforce administration.

Additional employment policies, notices, authorizations, or agreements may apply. If another applicable notice conflicts with this Privacy Policy, the more specific notice governs for the subject it covers.

14. Third-Party Websites and Services

Our websites, messages, and social-media pages may contain links to websites or services operated by others. We do not control and are not responsible for their content, security, or privacy practices. This Privacy Policy does not apply to information a third party collects under its own policy, including information collected directly by a financing provider, social-media platform, lead aggregator, or payment processor.

16. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our practices, technology, Services, or legal obligations. We will post the updated policy with a revised effective date. If required by law, we will provide additional notice or obtain consent before a material change applies to previously collected personal information.
